1. Acceptance of Terms

By accessing or using Telltale Solutions and the Cognoscere platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors, registered members, coaches, and clubs.

2. Description of Service

Cognoscere is a sailing analytics platform that allows users to upload, store, replay, and analyse VKX sailing race data files. The Service is provided by Telltale Solutions, an Australian business.

3. User Accounts

You must create an account to access most features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

You agree to provide accurate and complete information when creating your account. Accounts created with false information may be suspended or terminated.

4. Subscriptions and Payments

Core features of the Service — file upload, race replay, fleet comparison, cloud storage, and sharing — are free. Access to the Analytics features, including race analytics and the AI coach, requires a paid subscription of A$5.00 per month. Each account with a verified email address may view analytics for one race file free of charge as a trial.

Payments are processed by Stripe; we do not receive or store your card details. Your subscription renews automatically each month until cancelled. You can cancel at any time via the Billing link shown in the site header when signed in; cancellation takes effect at the end of the current billing period and you retain access until then. We will give existing subscribers at least 30 days' notice by email before any price change takes effect.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits your rights under those consumer guarantees, including your rights to a refund where the Service fails to meet them.

5. Acceptable Use

You agree not to:

• Upload files containing malicious code, malware, or any harmful content
• Attempt to reverse-engineer, decompile, or tamper with the Service
• Use the Service in any way that violates applicable laws or regulations
• Share access to your account with third parties without authorisation
• Upload files you do not own or do not have the right to upload
• Scrape, harvest, or collect data from the Service without written permission

6. User Content

You retain ownership of the VKX files and other content you upload to the Service ("User Content"). By uploading User Content, you grant Telltale Solutions a limited, non-exclusive licence to store and process your content solely to provide the Service to you.

You are solely responsible for your User Content. We do not endorse or assume liability for any User Content. We reserve the right to remove any content that violates these Terms.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your personal information.

8. Intellectual Property

The Service, including its design, code, branding, and all content created by Telltale Solutions, is protected by Australian and international intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

Analytics and data provided by the Service are for informational purposes only. Decisions made based on this data are the sole responsibility of the user.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Telltale Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of data, loss of revenue, or loss of goodwill.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may delete your account at any time via the Account Settings page.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or by posting a notice on the Service. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
